Partner terms.

A business sets itself up in Cartel and is reviewed by HYPEHAUS before anything is public. We may approve it for some activities and not others, and may ask for proof of identity, premises, licences or tax registration. You confirm that the people you add to your team act for the business, and you are responsible for what they do in Cartel.

• Describe a night, a menu or a piece truthfully: the price, the date and time, the line-up, the venue, the age policy, sizes and stock.
• You hold every licence and permission your activity needs, including for serving alcohol, for music and for the premises.
• You own, or have the rights to, every poster, photo and word you post, and you let HYPEHAUS display them to run and promote your listing.
• Posts, campaigns and collaborations are reviewed and may be refused or taken down. Paid placements are marked SPONSORED.

Admission is your decision and your responsibility, within the law. A valid HYPEHAUS pass is scanned in once; the scanner shows validity, the guest's @handle and Aura. If you cancel, postpone or materially change a night, guests are refunded under the Refunds page and the amount comes out of your share. For a refund request, you give a recommendation; HYPEHAUS decides.

You prepare and serve what is ordered and are responsible for the food, its allergens and your tax invoices. Money paid in the app for takeaways and bills is collected by HYPEHAUS and paid out to you; cash at your counter is yours and is only recorded. A tip is yours in full.

HYPEHAUS sells your pieces as the merchant of record at the price you set, less the commission agreed with you. You keep stock accurate, dispatch on time with a tracking number, and honour the return window shown to the buyer. The buyer's name and address are given to you only to deliver that order and must not be used for anything else.

A collaboration states its terms before you accept it. Commission accrues only on confirmed, paid sales through your link, at the rate fixed when the collaboration was accepted, and is reversed if the sale is refunded.

You do not receive a guest's phone number, email or identity from HYPEHAUS, and you must not try to obtain it through the service. Statistics are shown only for groups of ten or more. You must not export, sell or combine what you see in Cartel with other data to identify guests.

Our fees are on the Pricing page, or in your signed agreement where it states a different rate. Fees are shown in your statements as their own lines. Cartel PRO is an optional monthly plan per venue, charged by autopay until you stop it; it runs to the end of the period paid for.

• Money guests pay online is collected by HYPEHAUS and held before it is paid to you: for a night, until two days after the night; for a café, two days after payment; for a brand, until the order is delivered and its return window has closed.
• Payouts go by bank transfer or UPI to the account the owner has set, with a statement of every line.
• Refunds, chargebacks and returns after a payout are recovered from your later payouts or invoiced to you.
• You are responsible for your own taxes. HYPEHAUS invoices its fees to you.

Free pushes are limited as Cartel shows. Auction bids for top placements are prepaid; a bid that does not win is refunded. A placement that has run is not refunded.

We may pause a listing or suspend a business where we believe guests are at risk, the law or these terms are being broken, or payments are disputed, and we will tell you why. The owner may close the account at any time from Cartel once open orders, nights and payouts are settled.

You are responsible for your events, premises, staff, food and goods, and for claims arising from them. To the extent the law allows, HYPEHAUS is not liable for indirect or consequential loss, and its total liability to you is limited to the fees it earned from you in the three months before the claim. These terms are governed by the laws of India, and the courts at Nagpur, Maharashtra have exclusive jurisdiction.
